1. Acceptance of Terms
By registering for, accessing, or using Aafia EMR, you confirm that you are authorised to enter into this agreement on behalf of your organisation and that your organisation agrees to be bound by these Terms.
If you are accessing the Service as a representative of a healthcare facility, clinic, or medical practice, you warrant that you have the authority to bind that organisation to these Terms.
2. Description of Service
Aafia EMR is a cloud-based electronic medical records (EMR) and clinic management platform designed for healthcare providers operating in the Kingdom of Bahrain and the broader GCC region.
The Service includes modules for patient registration, appointment scheduling, clinical documentation, e-prescriptions, billing, insurance claims, laboratory management, inventory, and analytics. Features may vary by subscription plan and are subject to change with reasonable notice.
3. Account Registration & Responsibilities
To use Aafia EMR, you must register for an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify us immediately of any unauthorised access to or use of your account. The Company shall not be liable for any loss or damage arising from your failure to safeguard your login credentials.
4. Subscription, Payment & Billing
Access to Aafia EMR is provided on a subscription basis. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected. All fees are stated in US Dollar ($) unless otherwise specified.
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. No refunds are issued for partial billing periods except as outlined in our Refund Policy.
The Company reserves the right to change subscription prices with at least 30 days' prior written notice. Continued use of the Service following a price change constitutes acceptance of the updated pricing.
5. Privacy & Data Protection
Your use of Aafia EMR is subject to our Privacy Policy, which is incorporated into these Terms by reference. We are committed to protecting patient data in accordance with the Personal Data Protection Law (PDPL) of Bahrain and applicable GCC healthcare regulations.
6. Intellectual Property
All content, features, and functionality of the Aafia EMR platform — including software, code, design, text, graphics, and logos — are the exclusive property of Aafia Health Technology W.L.L. and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
7. Prohibited Activities
When using Aafia EMR, you agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws and regulations.
- Attempt to gain unauthorised access to any part of the platform or its underlying systems.
- Upload or transmit any viruses, malware, or other harmful code that could damage the Service or other users' systems.
- Share patient data outside the platform in ways that violate applicable data protection regulations.
- Reverse-engineer, decompile, or disassemble any part of the Service or attempt to extract the source code.
- Use the Service in a manner that could harm, disable, overburden, or impair its performance or availability for other users.
8. Data Security & Patient Data
As a healthcare platform handling sensitive patient information, we implement robust security measures including:
- End-to-end encryption of patient records and clinical data in transit and at rest.
- Regular security audits, vulnerability assessments, and penetration testing.
- Role-based access controls to ensure staff can only access data relevant to their responsibilities.
- Automatic session timeouts and multi-factor authentication options.
- Compliance with NHRA data governance requirements and Bahrain PDPL standards.

9. Limitation of Liability
To the maximum extent permitted by applicable law, Aafia Health Technology W.L.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the subscription fees paid in the three months preceding the claim.
10. Changes to These Terms
We reserve the right to update or modify these Terms at any time. We will provide at least 14 days' notice of any material changes via email or a prominent notice within the platform. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
